Terms of Service

Last updated 1 October 2026

These terms govern your use of the Executive Office website, client portal and executive operations services. By engaging us or using the portal, you agree to them. If you are accepting on behalf of a company, you confirm you are authorised to do so.

1. Our services

Executive Office provides executive operations support, which may include executive administration, project and action management, business operations support, reporting and KPI tracking, and maturity assessments. The specific services, scope and fees for your engagement are set out in your proposal or engagement letter, which forms part of these terms.

We provide operational support and reporting. We do not provide legal, tax, audit or regulated financial advice, and nothing we produce should be relied on as such.

2. Your responsibilities

  • Give us accurate, complete and timely information, and tell us when it changes.
  • Nominate a person authorised to give us instructions on your behalf.
  • Keep your portal login credentials secure, and tell us immediately if you suspect unauthorised access.
  • Make sure you have the right to share any information or documents you send us, including information about your own clients and employees.

Our work depends on the information and access you give us, so we are not responsible for delays or errors that result from information being late, incomplete or incorrect.

3. Fees and payment

Fees, billing frequency and payment terms are set out in your proposal or engagement letter. Unless agreed otherwise, invoices are payable on the terms stated on the invoice. We may pause work on overdue accounts after giving you notice.

Where online payment is offered through the portal, payments are processed by our payment provider under their own terms. We do not store your full card details.

4. Confidentiality

Each of us will keep the other's confidential information confidential and use it only for the purposes of the engagement. This does not apply to information that is public, that we already lawfully held, or that we are required to disclose by law or by a regulator.

5. Intellectual property

Our methodologies, frameworks, templates, assessment models, dashboards and the Executive Office OS™ remain our intellectual property. You receive a licence to use the outputs we prepare for you for your own internal business purposes. Your business information and documents remain yours.

6. Third-party services

The portal connects to third-party services such as calendar, video-conferencing, electronic signature and payment providers. Those services are governed by their own terms and availability, and we are not responsible for their acts, omissions or outages.

Where you install our mobile application from the Apple App Store or Google Play, your use of it is also subject to that store's own terms. Apple and Google are not parties to these terms and have no obligation to provide maintenance or support for the application.

7. Limitation of liability

To the extent permitted by law, our total liability arising out of or in connection with the engagement is limited to the fees paid by you for the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential loss, or for loss of profit, revenue or business opportunity.

Nothing in these terms limits any liability that cannot lawfully be limited, including under the Consumer Protection Act where it applies.

8. Term and termination

The engagement runs for the period stated in your proposal. Either party may terminate on the notice period set out there, or immediately if the other commits a material breach and does not remedy it within a reasonable time. Fees for work already performed remain payable on termination.

9. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these terms.

10. Governing law

These terms are governed by the laws of the Republic of South Africa, and the parties consent to the jurisdiction of the South African courts.

11. Changes to these terms

We may update these terms from time to time. The current version is always published on this page. Continued use of the portal or our services after an update means you accept the revised terms.
